TERMS OF USE

1. Developer, Apple license, and scope

These terms describe the AITENYA iPhone app and its paid features, provided by Ethirion Sp. z o.o., ul. 3 Maja 23, 42-400 Zawiercie, Poland, NIP: 6492319502. Contact: info.ethirion@gmail.com. The app is licensed under Apple's Standard Licensed Application End User License Agreement, unless a different agreement is selected in App Store Connect. These terms provide product and purchase information and do not replace non-excludable consumer rights or Apple's applicable license. By using the app, you agree to these terms and acknowledge our Privacy Policy.

2. What AITENYA provides

AITENYA uses the iPhone camera for on-device analysis of supported exercises, repetition counting, movement-related voice cues, timed holds, and local workout history. It does not promise to recognize every movement or identify every form issue. An iPhone with compatible iOS, Camera permission for live coaching, and a suitable setup are needed. Apple purchases require access to Apple's purchase service.

3. Free access and Premium

You can complete up to three standalone workouts or one training plan without a time-limited trial. The first of those completion limits reached ends free workout starts; you can still browse exercises, plans, settings, and saved history. AITENYA Premium unlocks further workout starts. The free allowance is based on completed activities, not days, and is not an Apple subscription trial. Browse availability and supported exercises may change with app updates.

4. Subscriptions and lifetime purchase

Premium is offered through Apple In-App Purchase as weekly, monthly, or annual auto-renewing subscriptions, or as a separate one-time lifetime purchase. The purchase screen and Apple's confirmation sheet show the current price, currency, billing period, and any offer that actually applies in your storefront. We do not promise a free subscription trial. An auto-renewing subscription is charged to your Apple account upon confirmation and renews for the selected period unless you cancel it. Apple may notify you about price changes and handle changes according to its terms. The lifetime option is a one-time, non-renewing entitlement to Premium features in AITENYA while the app and those features remain available; it is not a guarantee that the app or services will operate forever.

You can manage or cancel an active subscription in iPhone Settings > your name > Subscriptions, or use the Manage Subscription action in AITENYA Settings when available. Cancelling stops future renewals; access generally continues until the end of your paid period, subject to Apple's transaction status. Deleting the app or deleting local workout data does not cancel a subscription. Use Restore Purchases in the app to refresh eligible access for the same Apple account. Apple processes payments, refunds, and purchase disputes through its systems; contact AITENYA Support for app-access issues.

5. Fitness and medical limitations

AITENYA is a general fitness tool, not a medical device. It does not diagnose, treat, cure, prevent, or rehabilitate any condition, and does not replace a clinician, physical therapist, or qualified trainer. Consult a qualified professional before changing your exercise routine if you have a health concern, injury, are pregnant, or are unsure whether a movement is suitable. Stop exercising and seek appropriate help if you feel pain, dizziness, faintness, unusual shortness of breath, or other concerning symptoms.

6. Exercise and technology safety

Use a clear, stable, well-lit area and secure your phone so it cannot fall or cause a trip hazard. Follow the setup for the selected exercise and use appropriate equipment. Lighting, clothing, camera angle, distance, occlusion, and device performance can affect analysis. The app cannot measure internal joint load, pain, fatigue, breathing, or every unsafe condition. Counts, timers, form cues, estimated calories, and quality scores may be inaccurate. Do not rely on the app as your only safety measure or exercise supervisor.

7. App use and intellectual property

You may use the app for personal lawful purposes under Apple's license. Do not interfere with its security or operation, redistribute its content without authorization, or misuse the service; statutory rights to interoperability and other non-excludable rights remain unaffected. AITENYA branding, software, and original content are protected by applicable intellectual property law. Apple, iPhone, App Store, and Apple Vision belong to their respective owners; Apple is not the publisher of this website.

8. Availability, consumer rights, and changes

Features and supported devices may change for product, security, safety, or legal reasons. We do not promise error-free availability or a particular fitness result. To the extent allowed by applicable law, the app is provided as available, and indirect losses arising from inaccurate feedback or interruption may be excluded. Nothing here excludes liability for matters that cannot legally be excluded or limits mandatory consumer remedies, including rights relating to digital content and Apple purchases. If these terms change materially, we will update the date and provide appropriate notice. You may stop using the app and manage any active subscription through Apple.
